De Novo Hearings in Wisconsin

Many hearings in family law are conducted by family court commissioners, not by the judge assigned to the case. If you are not satisfied with a commissioner’s ruling in your divorce, you have the right to request a new hearing before the circuit court judge. This is called a De Novo hearing. De Novo means “from the beginning” in Latin.

De Novo Process

A De Novo review can only happen when there was a trial for your family law case, and that trial was overseen by a court commissioner, not a judge. Furthermore, there are specific time restraints on this request that vary by each county. To ensure you are able to get a De Novo review for your case, contact Divergent Family Law today.

De Novo Review vs Appeal

Unlike a De Novo, in an appeal the court is limited to reviewing errors in law, meaning they can only change something when there has been a legal mistake. Appeals are not a second shot at getting the best order for your future in the same way De Novos are.
